All orders are subject to technical verification and inventory confirmation. We reserve the absolute right to refuse or cancel transactions based on transparent merchant risk control or compliance requirements.

Order Processing, Operations, and Delivery Policies

To ensure financial security and prevent payment fraud, our logistics operations adhere to the following clearly defined standards:

Order Processing Time: After successful transaction authorization, all verified orders undergo rigorous quality checks and secure packaging at our warehouse within 1 to 3 business days (excluding German public holidays).

Logistics Carriers: After shipment, goods are delivered to a premium international express network (including DHL, FedEx, UPS, or equivalent high-priority postal networks) for distribution.

Estimated Delivery Time:

Europe: 5 to 12 business days from the date of actual shipment.

United States: 7 to 14 business days from the date of actual shipment.

Delay or Loss Guarantee: If an order fails to arrive within the standard delivery time due to customs clearance delays or carrier route issues, Scheeers Flowerpot GmbH will immediately initiate an urgent inquiry with the logistics service provider. If the package is confirmed lost in transit (a rare occurrence), Scheers Flowerpot GmbH will assume full responsibility and provide a full refund to your original payment account, or arrange for an immediate, free replacement.

Risk Transfer and Delivery Standards

For all consumers within the EU and the US, Scheers Flowerpot GmbH retains ownership of the package and assumes the risk of loss or damage in transit until the package is actually delivered to the delivery address you provided at checkout. Delivery is considered complete upon the carrier issuing an official electronic Proof of Delivery (POD).

Statutory Right of Withdrawal (EU/Germany Customers Only)

Under the EU’s strict consumer protection directives, consumers residing in Germany and the European Economic Area (EEA) have a statutory right to withdraw their purchase within 14 days of actual receipt of the goods without incurring any penalties.

Return Conditions: Goods returned during this “cooling-off period” must be completely unused, unaltered, and in their original packaging.

Damaged, Defective, or Wrongly Shipped Goods (Global Consumer Protection)

We strictly adhere to our Quality Control (QC) processes. However, if a product arrives with structural damage, a defect, or is incorrectly shipped:

For obvious defects, we may process a refund immediately without requiring you to return the damaged item.

Refund Execution and Bank Processing Time

Once our team formally approves the refund, the funds will be automatically returned to the original payment method used at checkout (via Stripe). Under no circumstances can the refund be transferred to another account. Although we process refunds internally immediately, according to international banking practices and card network procedures, the funds typically take 5 to 10 business days to appear on your account statement.

Pricing and Order Authorization

All prices displayed on www.flexiplanterrise.com are transparent and publicly available, representing the final purchase price. An order is only considered valid and enters the warehouse processing flow after successful payment authorization and verification against fraud.

Limitation of Liability

To the maximum extent permitted by applicable law, flexiplanterrise and Scheerers Flowerpot GmbH shall not be liable for any indirect, incidental, or consequential economic losses arising from unforeseen carrier delays, force majeure events, or customs clearance issues beyond our direct operational control. Nothing in these Terms limits our liability for fraud, personal injury, or gross negligence, provided that such liability cannot be excluded under German law.

Governing Law and Exclusive Jurisdiction

These Terms of Service and all commercial transactions are governed by and construed in accordance with the laws of Germany, while fully respecting and complying with all non-excluded mandatory consumer protection regulations of the European Union and your state in the United States. Any legal disputes shall be subject to the exclusive jurisdiction of the courts of Germany.
